1. Acceptance of these Terms
These Terms & Conditions ("Terms") constitute a binding legal agreement between you and Fun Fiesta Loungz ("we", "us", "the Platform", funfiestaloungz.com), a service operated by Afterburn Łukasz Spierewka (NIP 7252301429). By accessing or using the Platform in any way you confirm that you have read, understood, and unconditionally accept these Terms in full. If you do not accept them, you are not authorised to access or use the Platform and must leave immediately.
2. Virtual credits — no monetary value whatsoever
The Platform uses virtual credits only. Virtual credits: (a) have no monetary value of any kind; (b) cannot be purchased, sold, redeemed, withdrawn, cashed out, exchanged for money, goods, services, or anything of value; (c) cannot be transferred between users or accounts; and (d) confer no ownership, property right, or legal entitlement of any kind. We may modify, reset, suspend, expire, or revoke virtual credits at any time, for any reason or no reason, without notice and without any liability to you.
3. This is not social gaming
The Platform is an educational social-entertainment product. Nothing on it constitutes social gaming, betting, wagering, a lottery, or a game of chance for money or money's worth under the laws of Poland, the European Union, or any other jurisdiction. No real money is ever staked, won, or lost. You cannot win money and you cannot lose money. If your local law nonetheless restricts access to simulated gaming lounge-style content, it is solely your responsibility to comply and to refrain from using the Platform.
4. Eligibility and age
The Platform is restricted to natural persons who are at least eighteen (18) years old (or the higher age of majority in your jurisdiction). By using the Platform you represent and warrant that you meet this requirement. We reserve the right to refuse access, suspend, or terminate the access of anyone we reasonably believe to be under age, with no liability.
5. Accounts (optional)
Account creation is optional; gameplay does not require it. If you create an account, you are solely responsible for any activity under it and for the secrecy of your credentials. The local account feature stores a base64-encoded password hash in your browser only; this is obfuscation, not secure encryption, and you must not reuse an important password. We are not liable for any loss arising from unauthorised use of your device or account.
6. Acceptable use
You agree that you will not, and will not attempt to: (a) use the Platform for any unlawful, fraudulent, or abusive purpose; (b) reverse engineer, decompile, scrape, data-mine, or interfere with the Platform, its code, or its servers; (c) use bots, automation, exploits, or any means to manipulate gameplay, credits, or outcomes; (d) introduce malware or attempt to gain unauthorised access; (e) infringe our or any third party's rights; or (f) misrepresent your age or identity. Breach of this clause entitles us to terminate your access immediately and to pursue all available remedies.
7. Intellectual property
All content on the Platform — including the name "Fun Fiesta Loungz", the logo, text, graphics, symbol artwork, layout, code, and game designs — is owned by us or our licensors and is protected by copyright, trademark, and other laws. You are granted a limited, revocable, non-exclusive, non-transferable licence to access the Platform for personal, non-commercial use only. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the Platform without our prior written consent.
8. Disclaimer of warranties
The Platform is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of harmful components, or that any defect will be corrected. To the maximum extent permitted by law, you use the Platform entirely at your own risk.
9. Limitation of liability
To the fullest extent permitted by applicable law, in no event shall Fun Fiesta Loungz, its operators, directors, employees, or suppliers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, goodwill, virtual credits, or other intangible losses, arising out of or relating to your use of (or inability to use) the Platform, regardless of the legal theory and even if we have been advised of the possibility of such damages. Our aggregate liability for any claim relating to the Platform shall not exceed one hundred euros (€100) or the minimum amount permitted by law, whichever is greater. Nothing in these Terms excludes liability that cannot lawfully be excluded.
10. Indemnification
You agree to indemnify, defend, and hold harmless Fun Fiesta Loungz and its operators from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Platform, your breach of these Terms, or your violation of any law or the rights of any third party.
11. Suspension and termination
We may modify, suspend, or discontinue the Platform (in whole or in part) and may restrict or terminate your access at any time, with or without cause and with or without notice, without any liability to you. Sections that by their nature should survive termination (including 2, 7, 8, 9, 10, 12) shall survive.
12. Governing law and jurisdiction
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Subject to any mandatory consumer-protection rights you may have in your country of residence, the courts of Łódź, Poland shall have jurisdiction. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13. Changes to these Terms
We may amend these Terms at any time. The "Updated" date reflects the current version. Your continued use of the Platform after any change constitutes acceptance of the amended Terms.
14. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Platform.
